Terms & Conditions

1. ENTRY
1.1 These terms and conditions (the "Terms") shall apply to the Bristol 24-Hour Pedal Car Race (the "24-Hour Race") and the Junior Race (the "Junior Race") (together, the "Race").
1.2 The Terms apply to all entrants to the Race (the "Competitors"), Competitors' pedal cars (the "Cars") and those wishing to sponsor the Race ("Sponsors") or be advertised in connection with the Race ("Advertisers").
1.3 The Race is organised and administered by Bristol 24-Hour Pedal Car Race Limited a company incorporated in England with company number 08743636 and whose registered office is at 3 & 5 Station Road, Keynsham, Bristol BS31 2BH (the "Race Organiser" which expression includes our employees, event officials, authorised agents, sub-contractors or volunteers).
1.4 Submission of an application to the Race Organiser does not guarantee acceptance or entry to the Race, and the acceptance of applications shall be at the sole discretion of the Race Organiser.
1.5 By submitting an application to the Race Organiser for consideration of entry to the Race, you accept the application of these Terms and their governance of your participation in the Race.
1.6 Applications must be received by the Race Organiser at least one calendar month prior to the Race date. The Race Organiser takes no responsibility for applications delayed, incomplete, misdirected or lost for technical reasons or otherwise.
1.7 Successful applicants will be notified by post, telephone or email and the decision of the Race Organiser shall be final.
1.8 If any of your contact details change, you must inform the Race Organiser as soon as possible using the means provided on the Website. Failure to do so may result in you not receiving relevant information about the Race.
1.9 A copy of these Terms is attached to the application form and is also available on the Race website www.bristol24race.co.uk (the "Website").

2. SAFETY AND WELFARE
2.1 The Race Organiser shall use reasonable endeavours to protect the safety and welfare of the Competitors through the provision of certain safety and welfare facilities, but such provision by the Race Organiser shall not impose any responsibility or liability on the Race Organiser for the safety and welfare of the Competitors or any other person beyond any responsibility or liability imposed by law.
2.2 The Race Organiser and the Race shall be subject to scrutiny and risk assessment by Bristol City Council's Safety Advisory Group for Events (SAGE) team.
2.3 Participating in the Race is potentially hazardous and requires a suitable level of physical fitness and skill, and Competitors should not enter and participate unless they are medically able and properly trained.
2.4 It is the responsibility of Competitors to make sure they are medically fit and capable of participating in the Race. The Race Organiser reserves the right, in its absolute discretion, to stop any Competitor from taking part in the Race at any stage if the Race Organiser deems that person unfit or unsuitable to participate, including removal during the Race where necessary.
2.5 Participation in the Race is entirely at the Competitors' own risk and by entering the Race, Competitors acknowledge that the Race Organiser shall not be liable for death, injury, loss or damage arising from participation in the Race save to the extent that it is caused by our negligence.

3. CARS AND COMPETITORS
3.1 The Competitors must abide by and the Cars must conform to the rules and regulations set out by the British Federation of Pedal Car Racing ("BFPCR") in force and as varied from time to time and which are available here at the time of first publication of these Terms: http://www.pedalcars.info/info/rules/cars.asp and http://www.pedalcars.info/info/rules/index.asp.
3.2 These Terms shall take precedence over any contradictory or inconsistent clauses in the BFPCR rules.
3.3 Competitors agree to submit themselves and their Cars to pre-Race scrutiny if required by the Race Organiser or its agents.
3.4 The Race Organiser or its agents may, at their sole discretion, forbid a Competitor from entering or continuing to participate in the Race if they consider any Car or Competitor unfit, unsafe or unsuitable to participate in the Race.
3.5 The Race Organiser reserves the right, in its absolute discretion, to refuse to allow you to participate in the Race either at the start or at any point during the Race, should you be deemed to behave inappropriately or should it be deemed that your continued participation may cause offence or injury to yourself, any spectators, other Competitors or any other person. This includes but is not limited to displaying any clothing or other visual messages that may cause offence. Failure to comply with any instruction from Race marshals will result in ejection from the Race.

4. THE ROUTE
4.1 The Route depicted on the Website, in correspondence or in any publicity material may be changed by the Race Organiser without notice.

5. THE RACE TIMETABLE
5.1 The date, start and finish times of the Race (the "Race Timetable") indicated on the Website, in correspondence or in any publicity material may be changed by the Race Organiser without notice.
5.2 Notwithstanding clause 5.1, the Race Organiser will use reasonable endeavours to notify Competitors of any changes to the Race Timetable.

6. COMPOSITION OF RACE TEAMS
6.1 24-Hour Race teams may comprise mixed ages and genders with a minimum age of 11 on August 31st of the Race year.
6.2 Junior Race teams may comprise mixed ages and genders with a minimum age of 11 and maximum age of 18 on August 31st of the Race year.

7. TEAM ENTRY FEES
7.1 Competitors must pay the relevant entry fee to the Race Organiser in full cleared funds when applying to enter the Race.

7.3 The Race Organiser's payment details are set out on the Website.
7.4 Entry fees are non-refundable.

8. SPONSORSHIP AND ADVERTISING
8.1 Sponsors and Advertisers must pay the Race Organiser the relevant sponsorship and advertising fees in full cleared funds at least two calendar months prior to the Race date.

8.3 The Race Organiser's payment details are set out on the Website.
8.4 Sponsorship and advertising fees are non-refundable.
8.5 No Competitor will be listed or featured on the Website until the full entry fee is paid and no Sponsor or Advertiser will be shown on the Website until full payment has been received by the Race Organiser, although the Race Organiser shall be entitled to refer to such Sponsor or Advertiser on the Website or through other media.
8.6 The Website will be maintained for not less than one month after the Race, including reference to Sponsors and Advertisers relating to that year's Race.
8.7 One month after the date of the Race, all advertising and sponsorship credits may be removed from the Website, although the Website may be maintained without such credits at the Race Organiser's sole discretion.
8.8 Previous years' Competitors, Sponsors and Advertisers may remain listed on the Website at the Race Organiser's sole discretion.

9. SPECTATORS AND THIRD PARTIES
9.1 Spectators attend the Race at their own risk and are responsible for their own safety and welfare.
9.2 The Race Organiser will not be responsible for residents or business owners adjacent to the Route being disturbed or in any way inconvenienced by the Race or its spectators.

10. INTELLECTUAL PROPERTY RIGHTS
10.1 All intellectual property rights arising from or in relation to the Race are vested in and remain vested in the Race Organiser and shall not pass to or be otherwise licensed or exploited by or on behalf of any Competitor, Advertiser, Sponsor or any other person without the prior written approval of the Race Organiser.
10.2 Advance written permission must be sought from the Race Organiser for any commercial filming or photography.
10.3 Where permission is granted for commercial filming or photography, the Race Organiser will provide relevant permits and stewards will be instructed to apprehend anyone seeming to be engaged in commercial filming or photography without such a permit.
10.4 Competitors, Advertisers and Sponsors grant full and irrevocable permission to the Race Organiser, and any third parties authorised by the Race Organiser to use for any purpose any photographs, videotapes, motion pictures, website images, recordings or any other record of the Race that may include their image.
10.5 The Race logo and any reference to or use of the Race or Race Organiser shall not be used, published or circulated without prior written approval of the Race Organiser.
10.6 The Race Organiser reserves the right to use the details of Competitors, Advertisers or Sponsors in any publicity.

11. CHARITIES
11.1 Profits from the Race may be distributed to certain charities at the sole discretion of the Race Organiser.
11.2 Competitors may use the Race for their own charity fund-raising purposes.

12. TROPHIES
12.1 The winners of the Junior Race and the 24-Hour Race will be the teams measured to have completed the most laps by the end of each Race by their tags having passed over an electronic sensor pad. The Race Organiser's decision shall be final.

13. DATA
13.1 Your personal information will be used by us for purposes in connection with the Race and any subsequent events that the Race Organiser may organise or administer.
13.2 Competitors, Advertisers and Sponsors consent to their details being used by the Race Organiser for its own marketing purposes on acceptance of their application for entry to the Race.
13.3 Anyone not wishing to receive any further communications from the Race Organiser must confirm this in writing to the Race Organiser.
13.4 By entering the Race you grant full and irrevocable permission for us to pass any medical details you may have given us to the medical teams operating on the day of the Race.
13.5 Any personal data relating to Competitors will be used solely in accordance with current applicable data protection legislation and will not be disclosed to a third party without prior consent.

14. CANCELLATION
14.1 The Race Organiser reserves the right, in its absolute discretion, to cancel, delay or postpone the Race due to unforeseen or unavoidable circumstances out of its reasonable control. In such cases the Race Organiser will endeavour to inform participants as soon as reasonably practicable.
14.2 Where the Race has to be cancelled, delayed or postponed in accordance with clause 14.1 the Race Organiser shall not be liable for any inconvenience, expenses, costs, losses or damages suffered by Competitors.

15. FORCE MAJEURE (EVENTS OUTSIDE OUR CONTROL)
15.1 An Event Outside Our Control means any act or event beyond the Race Organiser's reasonable control.
15.2 The Race Organiser will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control.
15.3 If the Race does not take place in whole or in part due to an Event Outside Our Control then the Race Organiser shall have no liability to any Competitor, Advertiser or Sponsor and shall not be required or obliged to refund any fee or other consideration supplied.

16. DISCLAIMER
16.1 The Race Organiser shall be entitled to forbid entry to or participation in the Race, or withdraw any advertising or sponsorship benefits if any of these Terms are breached.
16.2 The Race Organiser shall not be obliged to refund any fees paid by Competitors, Advertisers or Sponsors if any of these Terms are breached.

17. LIABILITY
17.1 Subject to clause 17.3 the Race Organiser accepts no liability:
(a) for the acts or omissions of Competitors, Advertisers or Sponsors, including in each case their employees, agents, representatives or guests;
(b) where the Race has to be cancelled, delayed or postponed due to circumstances outside of our reasonable control (including, without limitation, adverse weather conditions or as a result of instructions from the local authority or emergency services);
(c) in respect of all and any action, claim, demand, proceedings, costs, expenses, fines, penalties, loss or damage whatsoever arising or resulting from or connected with the loss injury or damage sustained by or to any third party, any refusal by insurers to meet in full or in part any claim, any representation (unless fraudulent) or any implied warranty condition or other term or any duty at common law or under any express terms of these terms and conditions or otherwise for any loss of profit (whether direct or indirect), business, opportunity, goodwill, revenues anticipated or other loss or any indirect special or consequential loss or damage caused by negligence, breach of contract, tort, breach of statutory duty or otherwise arising out of or in connection with the race.
17.2 The Race Organiser does not exclude or limit in any way its liability for death or personal injury caused by its negligence.
17.3 Each Competitor, Advertiser or Sponsor for itself and all those for whom it is directly or indirectly responsible shall indemnify the Race Organiser, its officers, employees, agents, representatives and sub-contractors and shall hold harmless from and against all costs and expenses of whatever nature, actions, proceedings, claims, demands and damage made against or caused against the Race Organiser, its officers, employees, agents, representatives and subcontractors arising from any breach of or from failure to abide by these Terms or from any act or omissions on the part of the Competitor, Advertiser or Sponsor or those for whom it is responsible.

18. SEVERANCE
18.1 If any provision (or part of any provision) of these Terms is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, such provisions or part provision shall, to the extent required, be deemed not to be a part of these Terms, and it shall not affect the validity and enforceability of the other provisions of these Terms.

19. NO WAIVER
19.1 No failure or delay by a party to exercise any right or remedy provided under this agreement or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

20. NO PARTNERSHIP
20.1 Nothing in these Terms shall be construed as creating an association, partnership, joint venture, or relationship of agency or employment between the Race Organiser and any of the Competitors, Advertisers or Sponsors.

21. GOVERNING LAW AND JURISDICTION
21.1 These Terms are governed by English law and are subject to the exclusive jurisdiction of the Courts of England and Wales.
